Terms of Service

These Terms are an agreement between you and [Developer legal name], [Postal address] (“we”, “us”), for the Translatalo Android app, its backend and website (the “Service”). By creating an account or using the Service you accept these Terms. Our Privacy Policy explains how we handle personal data.

1. The Service

Translatalo adds an AI voice to regular phone calls made or received on your Android phone:

To work without root access, the app requires a one-time pairing with Android's Wireless debugging so that a helper process on your phone can capture and play call audio. Call audio is processed by a third-party AI provider (currently OpenAI). The Service depends on your device, Android version, carrier and network and may not work on every phone or call.

Refunds are handled by Google Play under its refund policy. You can request a refund through Google Play. Where your local consumer law grants you a right of withdrawal, note that by starting to use purchased minutes you request immediate performance, and the right of withdrawal may end once the digital service has been fully provided, as permitted by that law. Nothing in these Terms limits mandatory consumer rights.

5. Call recording and consent laws

When you use Translatalo on a call, the voices of you and the other person are processed by an AI service. Many jurisdictions require you to inform the other party, or obtain the consent of all parties, before call audio is recorded, intercepted or processed (for example, “two-party” or “all-party” consent laws). You, not Translatalo, decide when to use the Service on a call, and you are solely responsible for complying with all laws that apply to you and to the other party, including informing them and obtaining any required consent.

In assistant mode, the assistant introduces itself as your personal assistant. By default it does not say that it is an AI, but if sincerely asked, it does not deny being an AI. You can turn on “Say it’s an AI assistant” in the app's settings so that it introduces itself as an AI assistant. If the law where you or the other party are located requires disclosure that a call involves an AI or an automated voice, you must make that disclosure or turn on that setting.

Translations, captions and assistant speech are generated automatically by AI and can be inaccurate, incomplete, delayed or inappropriate. The assistant may misunderstand the other party or your instructions, or end the call. Do not rely on the Service for medical, legal, financial, safety-critical or other important matters without verifying the result. You are responsible for decisions made and commitments given on your calls, including those made by the assistant on your behalf.

8. No emergency calls

Do not use Translatalo for emergency calls. The Service is not designed for and must not be relied on to contact emergency services. If the Service interferes with a call, stop it and call directly.

9. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be unavailable because of maintenance, our providers, Android or device changes, carrier restrictions or network problems. We may change, suspend or discontinue features. If we discontinue the paid Service entirely, we will give reasonable notice and refunds will be handled as required by law and Google Play's policies.

10. Intellectual property

The Service, including the app and its design, belongs to us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you control, in line with these Terms and the Google Play terms. You keep any rights you have in what you say on your calls and in your instructions.

11. Third-party services

The Service relies on Google (sign-in, Google Play), RevenueCat (purchase management) and OpenAI (speech processing). Their terms and policies apply to their services. We are not responsible for third-party services outside our control.

12. Disclaimer

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement.

13. Limitation of liability

To the extent permitted by law: (a) we are not liable for indirect, incidental, special or consequential damages, or for lost profits, data or business opportunities; and (b) our total liability arising from the Service in any 12-month period is limited to the amount you paid us for the Service in that period. These limits do not apply to liability for intent or gross negligence, death or personal injury caused by negligence, or any other liability that cannot be limited under applicable law, and do not affect your mandatory consumer rights.

14. Indemnity

To the extent permitted by law, you will indemnify us against third-party claims arising from your breach of these Terms or of the law when using the Service, including consent and recording laws.

15. Termination

You can stop using the Service and delete your account at any time (Settings → Account → Delete account). We may suspend or terminate your account if you materially breach these Terms, misuse the Service or if required by law; where reasonable we will notify you first. Remaining minutes are lost on deletion or termination for breach. Sections that by their nature should survive termination (including 5, 7, 12–14 and 17) survive.

16. Changes to these Terms

We may update these Terms. We will post the new version here with a new effective date and, for material changes, notify you in the app or by email before they take effect. If you do not agree, stop using the Service and cancel your subscription.

17. Governing law and disputes

These Terms are governed by the laws of [Country], excluding its conflict-of-law rules. Courts of [Country] have jurisdiction, without prejudice to mandatory consumer protection rules that give you the right to bring proceedings in, and rely on the laws of, your country of residence.
